Scarborough Issues

Scarborough issues Both the Philippines and China continue to assert sovereignty over the same area in the South China Sea. We therefore have an â€Å"international dispute,† an element necessary before one can go to an international court. We want to settle the dispute through the judicial resolution provision in the United Nations Convention on the Law of the Sea (Unclos); but China does not. That is the bind we are in. Suppose, however, that China eventually agrees to go to court. Can the Unclos be the source of resolution?If we appeal to the convention, will we be contradicting ourselves, as some claim, by laying claim to an area which is outside the geographical limits of Philippine territory as delineated in the Treaty of Paris? Indeed, the Treaty of Paris is a good starting point. But the treaty is an 1890 document drafted and entered into on the basis of the understanding of what maritime laws were at that time and their limitations. At that time the division of the la w of waters was only between the territorial sea and the high seas. It said nothing beyond territorial waters.However, more jurisdictional divisions beyond territorial waters have developed since 1890. The territorial sea, as originally conceived, was the body of water which a coastal state could defend with the current range of cannons, a rather short distance. This was later expanded to the present 12 nautical miles. Within the territorial sea a coastal state could exercise certain restricted rights. Beyond the territorial sea were the high seas which were open to use and exploration by all. Things have changed radically since the early development of international law. The division into territorial sea and high seas is still there.But there have now come to be recognized certain zones of jurisdiction beyond the territorial waters. These developments are functional and resource-oriented and have come to threaten those who rely on traditional maritime rules. Thus, when you read of 22 Chinese vessels preventing Filipino vessels from entering the area around Scarborough Shoal, this is the problem we want the Unclos to resolve. The Unclos is not just a codification of customary international law but also goes beyond traditionally accepted rules. What are the new developments? First of all, we have to think of baselines.The Unclos allows states to draw baselines along the low water mark surrounding a coastal state. The baselines can either follow the indentations of the coast or they can be straight lines drawn from point to point. Straight baselines are allowed in archipelagos like the Philippines. Following the Unclos, we drew our baselines through the adoption of Republic Act 9522 modifying an earlier law. The baselines are important because the various zonal jurisdictions begin from there. Inward from the baselines are the internal waters over which a state exercises the same kind of jurisdiction it has over land.Outward from the baselines are 12 nautical mil es of territorial sea. This is still traditional international law. But recently there have been recognized, beyond the territorial sea and within the high seas, new zones of limited jurisdiction. These new zones of limited jurisdiction are the contiguous zone (24 nautical miles), exclusive economic zone (200 nautical miles), and the continental shelf. These are covered by complicated rules that are under the Unclos. In some areas there has also been recognized an exclusive fish zone (200 nautical miles). The new zones, especially the exclusive economic zones of neighboring states, can overlap.The rules for resolving overlapping jurisdictions are also found in the Unclos. The Philippines has been asking China to go to court to resolve issues that have arisen in the Scarborough area. We also have issues with other neighboring states. These too will eventually have to be resolved through the Unclos. The problem we have with China is not just about waters but also about land area. A st ate’s claim to any portion of the sea begins from its terrestrial jurisdiction. We have conflicting terrestrial jurisdiction with China. We are claiming land areas that are outside the lines drawn by the Treaty of Paris.The challenge for us is to be able to justify our claims under the present state of international law. Merely citing the shape or date of old maps will not settle the issues. The Philippines will not abandon its claim simply on the basis of the lines of the 1890 Treaty of Paris. We should not surrender our claims simply on the basis of old maps. There is new international law jurisprudence on conflicting land claims which have to be studied to see how applicable it is to the current conflicting claims. This is a challenge to the Philippine government. Is solidifying our claim to terrestrial area essential to winning our maritime claims?Under RA 9522 we reasserted our claim to a â€Å"regime of islands† outside the Philippine archipelago. Islands, accord ing to the Unclos, also have their maritime jurisdiction. (I am not sure if Scarborough Shoal qualifies as an island under Unclos. ) But the waters there are 120 nautical miles off the Zambales mainland, or within our exclusive economic zone. That is one basis of our claim, a good point to start from. P. S. Incidentally, Dr. Benito Legarda Jr. corrected me when I said in a previous column that Bajo de Masinloc means Below Masinloc. He is right. I have found since then that â€Å"Bajo† is the old form of â€Å"bajio† which means shoal.

Reaction Paper: Film About Life The Forest Has Essay

The film that we watched showed what kind of life the forest has and how large diversity of life inhabits in it. The trees are not only the living things that exist in it but many kinds of animals and insects as well. Life in the forest is so rich and there are many biotic forces that strive hard just to survive. Trees for example, need light for making food and getting energy but since they are too many in numbers, only the oldest and the strongest get to grow. Even so, since life is a cycle, a death of a powerful tree sheds birth to small plants and a new cycle or generation comes about. Animals have their way of surviving too. They usually go or live in large numbers so as to get a strategic territory. Chimpanzees for example live in colony and protect their habitat from other chimpanzees and other animals as well. They love fig trees too. Since many other animals like birds and squirrels like fig trees, the chimpanzees ward off their territories by creating noisy screams or sounds to frighten their enemies. Survival is the most important thing in the forest. One has to be strong to be alive and to keep their species reproducing. One also has to be wise and strong but it is not insurance to life. Many species became extinct and many reproduce a lot. I really like the film because it showed how diverse the biotic forces in the forest. It gave the viewers the glimpse of life in the forest and the never before seen happenings in it that lay people do not know or have no knowledge about. I learned how important our forest and the ecosystem in our life and how we should take good care of it. We should ensure it is healthy because if it dies, all the living organisms living in it will die. And surely, not long afterwards, the human race will die with it. Therefore, we should start conserving our forest. We should not wait until it is fully destroyed beyond repair because all the living forces will suffer the consequence, including us.

Calvinism also preached the doctrine of predestination whereby individuals were either saved or damned according to God's predetermined choice; and their covenant required the disciplining of the entire community; church member s were to observe the behavior of other members and report any transgressions to church elders whose job it was to punish violators of the community's covenant. The church had no direct role in civil government; however, "the Puritans believed that government was ultimately subordinate to the church". They sought to make public life fully conform to their view of God's law, "expecting strict observance of the Sabbath, refusing to celebrate Christmas and Easter, and censuring games of chance, music and dancing, among other things" (Roark, et al; 2007) The Puritans "created a civil government that was governed by Puritans for Puritanism; the leading officials in towns of the Colony were the 'freemen' who had to be male church members; they could vote for governor, deputy governor and other colonial officials. Client Consultation Whether you have your own event planning business or work full time planning events for one company you will work with clients. As a corporate events planner your internal clients will be other departments (HRD, Marketing, Operations etc). on the other hand if you are doing events planning independently you will be dealing with company representatives or in some cases the company officials themselves. In each case consultation will be of primary importance as these will determine the direction, objective and purpose and vision of the event. Other things to discus: who will be involved in the planning process, who will be the key decision makers, and how information should flow during the planning stage. This is precisely to anticipate and eliminate possible roadblocks as you can before you reach them since as the events planner it is your responsibility to take charge of planning. After the initial meeting and while it is still fresh on the mind of both parties (planner and client) summarize the discussion in writing and send a copy to the client if possible on the same day or soon after. 2. Set Objectives The best and most successful events have a clear purpose or objective. Event planners can avail of the SMART method for setting strategic objectives: Specific- What is the specific result of you event Measurable- Outcome should be measurable accurately Attainable- Given the existing budget and resources and constraint, is the objective attainable Relevant- Do the people involved have the authority, the skill and the resources needed to meet the objective? Is the objective important to the organization or individual? Time- Based- Is there a start and end point to the objective? Setting smart objectives will not only make the planning easier but will help measure the success of the event and create a positive experience for all involved. 3. Choose a Date and a Location At this planning stage, preferred date should be decided upon. Client will often but not always come with a date in mind for the event. If they don’t, it will be your job to help pick a suitable date. But whether you do the setting of the date or not you need to consider the following before choosing the date or accepting the client. Decide Who to Invite Your client needs to give you an idea of who they want to attend their event before you can begin to formulate a plan to attract the target audience or plan activities. Gender, median age, ethnic background, income bracket) Common or shared interest What payback does the client expect Where are the attendees coming from (travel arrangement, customs and traditions) 5. Create Your Theme The most memorable events have a cohesive theme that runs through-out, from initial publicity to printed invitations to decor and right through to the entertainment and final applause. One of the biggest advantages of a strong theme is its usefulness in helping you make decisions throughout the event process. Once a theme has been decided on, print materials such as invitations, banners, place cards, brochures, advertising and websites can be designed. It is used as a guide map for the event to assist when delegating responsibilities and show whether you are on track. 5. Budgets Creating a budget is an important ingredient in a successful event. Once you have created a timeline schedule and critical path, you can come up with a list of estimated expenses such as venue rental, food, transportation, accommodations, audio-visual equipment, printed materials and gifts. Get price quotations from your suppliers to find out how much a particular item costs You will also need to include your own fee and corporate clients may want to include any staff time they spend on the event as an expense. When planning a budget, include your potential revenue to offset the cost. For example, is the event a fundraiser? Is it a conference or convention that should aim to cover its own expenses? Attendance fees, sales of related materials, donations, ticket sales and sponsorships can all be good ways to raise revenues. Professionals and consultants, EVALUATING THE EVENT Evaluation of any event is concerned with the feedback from the event – not just from those who organized or staffed the event but from anyone who played a part in it. This could include: Staff Organizers Clients/Visitors Volunteers Sponsors Officials And other co-preneurs of the event planner When an event is planned the purpose of the event is clearly defined. It is against this that the event should be evaluated. Evaluation does not just take place at the end of an event. It is an ongoing process which occurs throughout the event. During the planning stage everything to do with the event is monitored and if any problems appear, adjustments have to be made. It is through this process that the event is finally stage and organized to meet the objectives of the event. **The opportunity to review and evaluate the event is important as a learning exercise. If the event is to be stage again in the future it is an invaluable help as the thing that went well can be repeated and those things that were not too successful can be changed next time. GENERAL GUIDELINES FOR EVENTS BE PREPARED. As the Scout motto says! Good preparation is the foundation for a good event. If the team as a whole are well prepared this will set the tone for the event. BE CLEAR ABOUT YOUR OBJECTIVES. Make sure that the all team fully understand what is to be achieved by the staging of this event. If all team members are will informed, everyone will be working towards the same goal. WORKS AS A TEAM. Any good team builds on the strength of its members and is supportive and helpful to each other. To operate effectively the team should meet on a regular basis and be able to communicate with each other with relative and be able to communicate with each other with relative ease. A good team has a good team leader at its front. This team leader should be a good motivator who can generate enthusiasm and perseverance. REMEMBER CUSTOMER CARE. A smile of welcome costs nothing and will affect the way visitors feel about the event. Remember, even if your stand/ job in the event isn’t very busy do not sir around looking bored and uninterested – this is sure to put potential clients off. Try to be alert, ready for action and enthusiastic at all times. If clients enjoy the event they will come back and tell their friends. BE RECOGNIZABLE. More and more teams in organizations are adopting their own uniforms. These help the visitors as it makes the staff immediately recognizable from the clients. When you stage an event you should consider adopting a uniform for all the staff involved in the event. This does not have to be complicated or expensive . For example, the team may decide to wear black trousers and a white T-shirt. These are items of clothing that most people have in their wardrobes. Plain colored T-shirts are relatively inexpensive to purchase. You may have the name of your event on the front, or local screen printer would do this at a small cost. This creates a good image for the visitors of the event and is something the rest of the team can keep to remind them of the event in the future. KEEP TO SCHEDULES. Reliability, both within the team and within the event itself, sis important. The team should make sure the all deadlines are met if it is at all possible to do so. Punctuality should be important for all team meetings etc. If someone is always late for a meeting it is unsurprising that other team members act on their knowledge and turn up, not at the start time of befo
